Fair Use Policy (FUP)

Applies To: All users and restaurant partners of KAAKO Technology Inc. (“KAAKO”, “we”, “us”, or “our”) through the KAAKO mobile applications, restaurant dashboard, and related services (collectively, the “Platform”).

1. Purpose and Scope

This Fair Use Policy (“Policy”) sets out the standards of acceptable use for all KAAKO Services operated by KAAKO Technology Inc. (“KAAKO”, “we”, “us”, or “our”).


It applies to all individuals and entities (“you”, “your”, “Users”, or “Partners”) who access or use:

  • KAAKO – User App, used by diners to search, book, and review restaurants; and

  • KAAKO – Restaurant Dashboard, used by restaurants and business partners to manage their listings, discounts, and reservations.

The Platform also includes community features allowing Users to submit user-generated content (“UGC”), including reviews, ratings, photographs, deal submissions, and Q&A posts. This Policy governs all such UGC and sets the standards for acceptable content and responsible participation.

This Policy forms an integral part of the KAAKO Terms of Service and, for restaurant partners, supplements the obligations set out in any Partnership Agreement executed with KAAKO.


All parties must ensure fair, respectful, and lawful use of the platform in compliance with this Policy, the Terms of Service, and the applicable Partnership Agreement.

2. General Conduct Requirements

You agree to use the Services in a manner that is lawful, responsible, and consistent with community standards.


You must not use the Services in any way that:

  • Violates any applicable law, regulation, or third-party right;

  • Disrupts, damages, or interferes with the proper functioning of the Services or related systems;

  • Harasses, threatens, abuses, or discriminates against any individual or business; or

  • Misrepresents your identity, affiliation, or relationship with KAAKO or any restaurant.

3. Prohibited Activities – User App

Users (diners) are strictly prohibited from engaging in the following behaviors:

  • Fraudulent Bookings – Making fake or duplicate reservations, repeated no-shows, or cancellations intended to manipulate restaurant availability or discount visibility.
     

  • Failure to Inform Staff – Not notifying restaurant staff of your KAAKO booking or booking code before ordering, resulting in disputes or attempted misuse of discount privileges.
     

  • Review Manipulation – Posting false, misleading, or paid reviews, or attempting to influence another user’s review or rating.
     

  • Referral and Coupon Abuse – Creating multiple accounts, impersonating others, or using unauthorized methods to exploit referral programs, coupons, or promotions.
     

  • System Misuse – Attempting to gain unauthorized access to the app, scraping data, using bots, or interfering with network security.
     

  • Inappropriate or Improper Conduct – Engaging in harassment, hate speech, or abusive language toward restaurants, KAAKO staff, or other users.
     

  • Late or Repeated Cancellations - Failing to cancel a booking at least five (5) minutes before the reservation start time, or repeated last-minute cancellations, may be considered misuse of the Service.
     

  • Discount Misuse - Attempting to claim a discount outside the booked time slot, or failing to inform restaurant staff of your KAAKO booking when required, constitutes a violation of these policies.
     

  • UGC Misrepresentation – Posting false, misleading, or fabricated reviews, ratings, deal information, or Q&A responses that do not reflect genuine personal experience.
     

  • Inappropriate or Harmful Content – Submitting UGC that contains harassment, hate speech, discrimination, offensive language, personal information, or copyrighted materials without permission.
     

  • Photo Upload Violations – Uploading photos that include identifiable individuals without consent, contain inappropriate or unsafe imagery, or misrepresent the dining experience.
     

  • Q&A Abuse – Posting irrelevant, spam, harmful, promotional, or deceptive questions or answers, or attempting to pressure or harass restaurants through repeated or inappropriate Q&A submissions.
     

Violation of any of the above may result in account suspension, restriction of booking privileges, or permanent termination of your account.

4. Prohibited Activities – Restaurant Dashboard (Partners)

Restaurant Partners must use the KAAKO Dashboard responsibly and accurately, and must also comply with all requirements and operating standards described in their Partnership Agreement with KAAKO.
 

The following actions are strictly prohibited:

  • False Listings – Submitting misleading information such as fake restaurant names, menus, photos, cuisine types, opening hours, or contact details.
     

  • Discount Misrepresentation – Advertising discounts, happy hour periods, or promotions not actually available at the venue, or publishing quotas that do not reflect real seating availability.
     

  • Data Manipulation – Artificially inflating booking numbers, ratings, or popularity metrics; creating fake bookings; or engaging in any activity intended to distort platform analytics.
     

  • Non-Compliance – Failing to honor confirmed reservations, applied discounts, or coupon reimbursements; enforcing unapproved conditions; or refusing to apply discounts that were displayed on KAAKO.
     

  • Abusive Behaviour – Harassing users, posting offensive content, or attempting to retaliate against negative reviews or UGC submissions.
     

  • Payment Misconduct – Refusing to settle invoices, commissions, coupon reimbursements, or other amounts owed under the Partner Agreement.
     

  • UGC Interference – Attempting to influence, suppress, intimidate, or incentivize users to alter or remove reviews, ratings, photos, Q&A entries, or deal-related submissions.
     

  • Fake or Misleading UGC – Submitting false reviews, Q&A answers, photos, menu information, or deal updates under personal, staff, or third-party accounts; or instructing employees to post fake content.
     

  • Unauthorized Image Use – Uploading copyrighted or non-owned images, stock photos, or competitor photos as restaurant profile images or menu/happy hour photos.
     

  • Q&A Manipulation – Posting fake questions or answers to influence public perception, mislead users, or artificially improve search visibility.
     

KAAKO reserves the right to remove or suspend restaurant listings that repeatedly violate this Policy, engage in UGC manipulation, or receive excessive customer complaints.

5. Security and Technical Integrity

You may not attempt to compromise or bypass KAAKO’s security mechanisms, including:

  • Circumventing authentication or Firestore data-access controls;
     

  • Introducing viruses, malware, or harmful code;
     

  • Performing penetration testing, load-testing, security scanning, scraping, or automated data extraction without KAAKO’s express written permission.
     

Any such conduct may lead to immediate suspension and potential legal action.

6. Monitoring and Enforcement

KAAKO actively monitors platform activity to ensure compliance.
We may investigate suspected violations and take any action deemed appropriate, including:

  • Temporary or Permanent Suspension – Restricting or disabling accounts or restaurant listings involved in fraudulent, abusive, or non-compliant activity.
     

  • Content Removal – Deleting or hiding fraudulent, inaccurate, misleading, abusive, or non-compliant content, including reviews, ratings, photos, Q&A entries, deal submissions, or any other UGC.
     

  • Booking or Promotion Cancellation – Cancelling affected bookings, discount sessions, or promotional campaigns that were created or manipulated in violation of this Policy.
     

  • Reward Reversal – Withholding or reversing referral credits, coupons, or promotional rewards obtained through misuse or policy violations.
     

  • Legal Reporting – Reporting unlawful activity, fraud, harassment, or security threats to law-enforcement agencies or regulatory authorities.
     

  • UGC Enforcement – Reviewing, moderating, anonymizing, or removing any user-generated content that violates this Policy; restricting UGC posting privileges; or suspending users who repeatedly submit harmful, deceptive, defamatory, or abusive UGC.

All enforcement actions are at KAAKO’s sole discretion. KAAKO may restrict or suspend accounts that repeatedly violate booking-timing or discount-eligibility rules.

7. User-Generated Content (UGC) Rules

Users may submit reviews, ratings, photos, Q&A entries, and deal-related submissions (“UGC”) through the KAAKO Platform.
All UGC must be truthful, respectful, and compliant with this Policy and KAAKO’s Terms of Service.

The following actions are strictly prohibited:

 

  • False or Misleading Content – Submitting fabricated reviews, inaccurate deal information, fake menu updates, or Q&A answers not based on genuine personal experience or verified observation.
     

  • Paid or Incentivized Reviews – Posting reviews, ratings, or Q&A responses in exchange for money, discounts, free items, or any form of compensation, whether offered by a restaurant or a third party.
     

  • Inappropriate or Harmful Content – Posting offensive, abusive, hateful, discriminatory, defamatory, obscene, or threatening material in reviews, photos, comments, or Q&A posts.
     

  • Personal Information Disclosure – Including personal information (such as phone numbers, addresses, private conversations, or identifiable individuals in photos) within UGC.
     

  • Copyrighted or Unauthorized Images – Uploading copyrighted images, stock images, competitor images, or photos you do not own, including photos taken from websites, social media, or other platforms without permission.
     

  • Spam or Irrelevant Posts – Posting promotional content, advertisements, repetitive comments, irrelevant questions, or non-restaurant-related material within reviews or Q&A sections.
     

  • Deal/Menu Fabrication – Submitting deal periods, happy hour data, menu items, or pricing information that you know is outdated, incorrect, or intentionally misleading.
     

  • Fake Q&A Activity – Posting fake questions or answers, impersonating others, or manipulating Q&A to influence public perception or promote a restaurant.
     

  • Harassment or Retaliation – Targeting restaurants, users, or staff with personal attacks, coordinated harassment, or retaliatory reviews or comments.
     

  • Manipulative Behavior – Attempting to artificially influence restaurant rankings, visibility, or credibility through coordinated posting, mass reviews, or false claims.
     

  • Image Violations – Uploading photos that include identifiable individuals without consent, unsafe situations, or inappropriate or sensitive imagery not suitable for public display.

 

KAAKO reserves the right to review, edit, hide, anonymize, or remove any UGC that violates this Policy. Repeated violations may result in posting restrictions, suspension, or permanent account removal at KAAKO’s sole discretion.

8. Reporting Violations

Users and Partners are encouraged to report any suspected misuse or violation of this Policy by emailing info@kaako.ca.


We will investigate all valid reports and take action where appropriate.

9. Consequences of Violation

Violations of this Policy may result in:

  • Immediate account suspension or termination;
     

  • Permanent removal from KAAKO platforms;
     

  • Forfeiture of rewards, credits, or promotional benefits; and
     

  • Legal proceedings or claims for damages where applicable.
     

KAAKO reserves the right to determine the severity of enforcement based on the nature and frequency of violations.

10. Policy Updates

KAAKO may update this Fair Use Policy from time to time.


Revisions will be posted with a new “Last Updated” date and, when material changes occur, KAAKO will notify users via email or in-app notice.


Continued use of the Services following such updates constitutes acceptance of the revised Policy.
